MYWORKSHOP - GENERAL TERMS AND CONDITIONS OF SERVICE

1. ACCEPTANCE & GOVERNANCE OF AGREEMENT
By initializing, registering, logging into, or utilizing the MyWorkshop Management Suite ("the Platform", "Service", "System", or "Software"), your business entity ("User", "Operator", "Workshop Owner", or "Subscriber") agrees to be legally bound by these General Terms and Conditions. This Master Service Agreement governs all sector-specific workstations including Automotive Garages, Two-Wheeler Workshops, Mobile & Electronics retail stores, Spare Parts Retail Counter Outlets, and Industrial Machine Shops. If you do not agree to these terms, you must immediately cease accessing the Platform.
2. COMPREHENSIVE SERVICE & MODULE DESCRIPTION
MyWorkshop provides cloud-native Enterprise Resource Planning (ERP), automated GST billing, inventory tracking, and workflow management software designed specifically for MSME service and retail enterprises across India. Key integrated capabilities include:
Automotive & Two-Wheeler Module: Digital job sheet creation, vehicle registration number lookup, chassis VIN logging, mechanic labor rosters, itemized parts estimate generation, and multi-point vehicle inspection checklists.
Electronics & Mobile Repair Module: Device repair memos, IMEI tracking, serial component logs, diagnostic status queues, technician assignment, and counter sales.
Industrial & Machine Shop Module: CNC/VMC machine rosters, cutting tool insert tracking, raw material stock ledgers, measuring instrument logs, and B2B Purchase Order generation.
Core Unified Features: HSN/SAC GST invoicing engine, WhatsApp PDF invoice and job card delivery, inventory barcode scanning, automated service due reminders, expense management, and financial profit analytics.
3. SUBSCRIPTIONS, COMMERCIAL TERMS & STRICT NO-REFUND POLICY
15-Day Industrial Trial Period: New workshop nodes are provisioned with a 15-day full-feature trial to enable operators to evaluate all platform capabilities, tax configurations, and sector workflows prior to financial commitment.
Commercial Subscription Options: Continued commercial workstation access requires an active commercial subscription (available in 3-month, 6-month, or 12-month billing cycles).
Strict No-Refund Policy: All subscription payments, including quarterly, semi-annual, and annual renewals, are strictly non-refundable. Because a 15-day full-access trial is provided prior to payment, MyWorkshop does not offer prorated refunds, partial credits, or payment reversals under any circumstances once a plan is purchased.
4. DATA RETENTION, ACCOUNT INACTIVATION & AUTOMATED DATA PURGE
Subscription Expiration & Inactivation: Upon the conclusion of a paid plan or trial without immediate renewal, the workshop node enters an "Inactivation Period" (Read-Only Status).
90-Day Grace Window: Business records remain safely stored on our secure cloud servers for up to 90 days (3 calendar months) following account expiration.
Permanent Data Purge Protocol: If a subscription is not renewed within 90 days of inactivation, all associated business records—including customer databases, tax invoices, job card history, inventory ledgers, and technician logs—will be PERMANENTLY PURGED from our primary and backup database servers. MyWorkshop bears no liability for data loss or operational disruption resulting from failure to renew within this 90-day grace period.
5. REGULATORY & TAX COMPLIANCE RESPONSIBILITIES
The User retains sole legal responsibility for the accuracy of all professional documents generated on the Platform, including GST calculations, HSN/SAC code mapping, CGST/SGST/IGST tax splits, and customer GSTIN validation under Indian GST law.
Users must ensure that mandatory industry identifiers (such as motor vehicle registration numbers or mobile device IMEI codes) are recorded accurately to maintain statutory audit integrity.
6. INTELLECTUAL PROPERTY & THIRD-PARTY TRADEMARK DISCLOSURES
All proprietary software code, interface design tokens, logo graphics, and brand marks belong exclusively to MyWorkshop.
Third-Party Marks: All third-party logos, brand names, and trademarks (including WhatsApp, Google Pay, PhonePe, LinkedIn, Instagram, Facebook, X/Twitter, and YouTube) displayed across the platform belong exclusively to their respective owners. Their inclusion is solely for user navigation, identification, and communication workflows. Their appearance does not imply endorsement, sponsorship, or formal corporate partnership.
7. LIMITATION OF LIABILITY & SYSTEM WARRANTY
The Platform is provided on an "as is" and "as available" basis. MyWorkshop does not warrant uninterrupted uptime or guarantee that software functions will meet all custom workflow requirements. In no event shall MyWorkshop be liable for indirect business interruptions, physical asset damage (including vehicles or electronic devices), lost revenues, or loss of profits arising out of platform usage.
8. GOVERNING LAW & JURISDICTION
This Master Agreement shall be governed by and construed in accordance with the laws of India. Any disputes or legal proceedings arising out of platform usage shall fall under the exclusive jurisdiction of the competent courts in India.
